The NGOs Condemn the over use of Force against the Peaceful Demonstrations & Call for Independent Investigation with Those Committing Such Acts
The NGOs, signatories of this statement, express their deep concern and sorrow over the breach of the Egyptian citizens' right to peaceful demonstrations as a way of exercising the right to peaceful assembly.
The said NGOs also condemn violence and the over use of force against such peaceful assemblies which were initiated in January 25th, 2011 till the date of the issuance of the subject statement. Furthermore, they denounce the breach of the right to life and to physical safety of those involved in the peaceful protests.
The signatory NGOs express their sorrow for the consequences of such breaches as seven civilians died and hundreds were injured. In addition, a large-scale detention campaign was launched against the protesters.
The signatory NGOs are concerned over and astonished with the over aggression used against the peaceful protesters as the Egyptian riot police tortured them, in a way which showed retaliation, so as to separate the peaceful assemblies.
The signatory NGOs point out that the riot police, who took the form of militias wearing civil clothes, used instruments and sticks brutally against the protesters while the protesters were not using any weapons or instruments incriminated by the Egyptian law.
The NGOs, signatory to the subject statement, believe that the ways used by the Egyptian riot police to separate the assemblies whether in Cairo, Suez, or the other Egyptian regions make the Egyptian Interior Ministry accused of many crimes like murder, the over use of force and torture which are incriminated by the Egyptian Penal Code and the international instruments in accordance with Article (7) of the Rome Statute of the International Criminal Court.
The signatory NGOs refer to the comprehensiveness of the right to peaceful assembly ensured by Article (47) of the Egyptian Constitution as well as the international instruments and covenants; namely Article (20-1) of the Universal Declarations of Human Rights which states that " everyone has the right to freedom of peaceful assembly and association." and Article (21) of the International Covenant on Civil and Political Rights which provides that "the right of peaceful assembly shall be recognized. No restrictions may be placed on the exercise of this right other than those imposed in conformity with the law and which are necessary in a democratic society in the interests of national security or public safety, public order (ordre public), the protection of public health or morals or the protection of the rights and freedoms of others.".
However, the current situation shows many breaches of the right to life, freedom, physical safety and the peaceful assembly.
The signatory organizations are calling upon the Egyptian government to comply with the international instruments; namely the International Covenant on Civil & Political Rights which she adopted in January 14th, 1982 and came into force in April 14th, 1982 and to ensure the right to peaceful assembly as a means of the political participation necessary for establishing actual democratic regime and a basis of the other rights which lose their value unless the freedom of expression is granted. Furthermore, the NGOs, signatory to the subject statement, call for releasing the detained protesters and carrying out an independent investigation on the over use of aggression against the peaceful protesters.

تدين الاستخدام المفرط للقوة في مواجهة المسيرات السلمية
وتطالب بتحقيق مستقل مع مرتكبى تلك الافعال
تعرب منظمات المجتمع المدنى الموقعة على هذا البيان ، عن قلقها البالغ واستياءها الشديدين بشأن الاخلال بحق المواطنين المصريين في القيام بمظاهرات أو مسيرات سلمية ، باعتبارها شكل من اشكال ممارسة الحق في التجمع السلمى .
كما تعبر المنظمات الموقعة عن إدانتها بشأن العنف والاستخدام المفرط للقوة تجاه تفريق هذه التجمعات السلمية التى بدأت بتاريخ 25 يناير من العام 2011وحتى تاريخ إصدار هذا البيان ، وما نتج عن ذلك من انتهاك للحق في الحياة والحق في السلامة الجسدية للمتظاهرين سلميا .
كما تعرب المنظمات الموقعة عن آسفها لما نتج عن هذه الانتهاكات من قتلى من المدنيين المتظاهرين سلميا، بلغ عددهم 7 قتلى إضافة الى مئات الجرحى ، وكذلك حملة الاعتقالات واسعة النطاق بحق المشاركين في هذه المسيرات .
وتثور لدى المنظمات الموقعة العديد من بواعث القلق والدهشة بشأن استخدام العنف و القوة المفرطة في مواجهة المتظاهرين سلميا ،لدرجة تصل الى حد التعذيب وتضفى على ممارسات الجهات الأمنية المصرية وهى في سبيلها لتفريق التجمعات السلمية الطابع الانتقامى .
وتشير المنظمات الموقعة الى استخدام قوات الأمن والتى تم رصدها في صورة ميلشيات ترتدى أزياء مدنية ، لأدوات وعصى تستخدمها بطريقة وحشية في مواجهة المتظاهرين ، وعلى الجانب الآخر لم يتم رصد حمل هؤلاء المتظاهرين لأى أسلحة أو أدوات يجرمها القانون المصري .
وترى المنظمات الموقعة على هذا البيان ، أن ممارسات الجهات الأمنية المصرية ، وهى في سبيلها لتفريق التجمعات السلمية، سواء في القاهرة أو السويس أو غيرها من الأقاليم المصرية، تضع وزارة الداخية المصرية تحت طائلة القانون بتهم القتل والاستخدام المفرط للقوة والتعذيب ، وهى جرائم مؤثمة وفقا لقانون العقوبات المصرى وكذا المواثيق الدولية،وفقا لأحكام نص المادة (7 ) من ميثاق روما بشأن المحكمة الجنائية الدولية .
وتشير المنظمات الموقعةالى شمول الحق في التجمع السلمى بحماية الدستور المصري في المادة (47 ) وكذلك بحماية المواثيق والتعهدات الدولية المتمثلة في نص المادة 2 من البند الأول للإعلان العالمي لحقوق الإنسان التى نصت على أنه “لكل شخص حرية الاشتراك في الجمعيات والاجتماعات السلمية”، ونص المادة 21 من العهد الدولي الخاص بالحقوق المدنية والسياسية التى نصت على أن “يكون الحق في التجمع السلمي معترفا به، ولا يجوز أن يوضع أي من القيود على ممارسة هذا الحق، إلا تلك التي تفرض طبقا للقانون وتشكل تدابير ضرورية في مجتمع ديمقراطي لصيانة الأمن القومي أو السلامة العامة أو النظام العام أو حماية الصحة العامة أو الآداب العامة أو حماية حقوق الآخرين وحرياتهم”.
وعلى الرغم من ذلك جميعه فإن يوميات الأحداث في هذه الآونة تشير الى العديد من الخروقات للحق في الحياة والحق في الحرية والأمان الشخصي والحق في التجمع السلمى .
وتطالب المنظمات الموقعة ، الحكومة المصرية باحترام تعهداتها الدولية ، سيما العهد الدولى الخاص بالحقوق المدنية والسياسية والذي صادقت عليه مصر في 14 يناير 1982 ودخل حيز النفاذ فى14 ابريل من ذات العام . وضمان حماية الحق في التجمع السلمى باعتباره إحدى الوسائل للمشاركة السياسية الضرورية لبناء نظام حكم ديمقراطي فعلي، و أساسا ترتكز عليه باقي الحقوق التي تتفقد قيمتها إذا لم توفر الحرية للتعبير عن الآراء والأفكار.
كما تطالب المنظمات الموقعة السلطات المصرية بالأفراج الفورى عن المتظاهرين اللذين تم اعتقالهم ، وفتح تحقيق مستقل حوق وقائع استخدام القوة المفرطة ضد المتظاهرين .
